Therefore, it is your responsibility to carefully read and ensure your agreement with these Terms and the Privacy Policy before accessing or using the site.

Please be advised that when you purchase our products and subscribe to our services, you will also be subject to the relevant License or End User License Agreement (“EULA”), which applies to the specific product subscription and products you have purchased. This License should be read together with these Terms and the Privacy Policy, collectively referred to as the “Agreement.” Capitalized terms used but not defined herein shall have the respective meanings given to them in the License.

You hereby represent and warrant that: (1) you have read the Agreement, understood the stated therein and you hereby agree to engage with the Company under its terms; (2) your age does not limit you from lawfully engaging in the Agreement and that you are not legally prohibited from entering into the Agreement; (3) you are authorized to enter into and fulfill the Agreement on behalf of yourself or the specified entity when purchasing our products.

Introduction and Eligibility

1. Revisions to the Agreement
WE RESERVE THE RIGHT TO MODIFY THIS AGREEMENT AT ANY TIME, IN OUR SOLE DISCRETION. PLEASE REGULARLY CHECK THESE TERMS FOR ANY UPDATES. when changes are implemented, Routed Sound will provide a new version of the agreement on the website. we will also update the “last updated” date at the top of the agreement. any amendments to this agreement will take immediate effect for new users of the service and on the stated effective date for existing users (referred to collectively as “users”). Routed Sound may require you to consent to the updated agreement in a specified manner before you can continue using the service. if you disagree with any of these changes after receiving notice, you must cease using the service. otherwise, your continued use of the service implies your acceptance of these changes.

2. Eligibility
To use the Service, you must be at least 18 years old. By accessing or using the Service or agreeing to these Terms, you affirm and warrant that: (a) you are at least 18 years old; (b) you have not been previously suspended or removed from the Service; and (c) your use of the Service complies with all applicable laws and regulations. If you are an individual representing an entity, organization, or company, you warrant that you have the authority to bind such entity, organization, or company to the Agreement.

Registration and Account

1. Opening an account

1.1. Creating Your Account: To access specific sections of the Service, you must complete the account registration process (“Account”) by providing a valid email address, username, password, and other requested information as indicated on the registration form. During registration, you are prohibited from selecting or using a username that:(a) Belongs to another person with the intent to impersonate that individual;(b) Infringes upon the rights of a person other than yourself without proper authorization; or(c) Is otherwise offensive, vulgar, or obscene. For instance, you cannot register using the name of a musical artist unless you possess the right to use such a name.
1.2. Username Guidelines: We retain the right to reject any username or to revoke your username and assign it to another user of the Service at our sole discretion, without any liability to you. You affirm and warrant that:(a) The information you provide to us during registration and at all other times will be accurate, up-to-date, and complete. (b) You will consistently update this information to ensure its accuracy, currency, and completeness.

If you provide any information that is untrue, inaccurate, outdated, or incomplete, or if we have reasonable grounds to suspect any inaccuracies in the information you provide, we reserve the right to suspend or terminate your Account and deny any present or future access to the Service (or any portion thereof). You also agree not to create an Account or use the Service if you have been previously removed or banned from using the Service.

2. Your Login Credentials

2.1. Confidentiality and Responsibility: It’s your responsibility to maintain the confidentiality of your login credentials. You are fully accountable for all activities conducted using your credentials. If you suspect any breach of confidentiality or unauthorized account use, please promptly inform us at [email protected]. We will not be held liable for any losses or damages resulting from unauthorized credential use.
2.2. Minors and Account Monitoring: You agree to actively monitor your account to prevent access by minors and accept full responsibility for any unauthorized use of the service by minors.

3. Your Account
Regardless of any other provisions stated herein, you acknowledge and agree that you do not possess any ownership or property interest in your account. Furthermore, you acknowledge and agree that all rights associated with your account are and will forever be owned by and for the benefit of Routed Sound.

Product and Service

All Routed Sound products and services are bound by the terms of the End User License Agreement.

1. General
Our products and services offer a platform designed to provide you with resources for music creation and collaboration enhancement. It is owned and operated by Routed Sound. The visual interfaces, graphics, design, compilation, information, data, products, software, services, and all other elements of the Service provided by Routed Sound are protected by intellectual property and other applicable laws. Furthermore, all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, and other materials included and made available to you by Routed Sound in the Service are the property of Routed Sound or its third-party licensors (the “Routed Sound Property”). You are only permitted to use the Routed Sound Property as provided in these Terms, and Routed Sound reserves all rights to the Routed Sound Property not expressly granted in this agreement.

2. Your Use of the Service and Routed Sound Property
Unless expressly authorized in writing by Routed Sound, including permissions provided within the Service (e.g., for commercially licensed versions of Routed Sound), you are granted the authority, subject to this Agreement, to access and utilize the Service and the Routed Sound Property solely for your personal or internal business purposes, at our discretion. Any other usage is explicitly prohibited.

3. License and Ownership Terms

  • 3.1. Grant of License: In consideration of the license fee (“LICENSE FEE”) you have paid (or for our FREE download packs), Routed Sound grants a “MEDIA LICENSE” to you and your assignees, subject to the transfer limitations described herein. The MEDIA LICENSE for this product is exclusively granted to a single user. Special arrangements may be considered for multiple users on a case-by-case basis.The usage of these products, especially samples, instruments, and presets, for creating a sound library, sample library, sample-based product, or other musical instrument, is strictly prohibited. Individual samples, stems, sound sets or audio loops must not be distributed, whether for commercial or non-commercial purposes, as standalone products. Furthermore, Routed Sound’s sound-based products, such as VST presets, audio loops, sample packs, and stem files (collectively referred to as the “CONTENT”), may not be repackaged, either in whole or in part, as audio samples, sound libraries, or sound effects. Use of the free edition of these products or their components for commercial purposes is strictly forbidden.This license is non-transferable and explicitly prohibits resale.

    You are not permitted to install the CONTENT on a network server without first contacting Routed Sound and obtaining a Network license for each workstation that is being served on the network. Additionally, you may not:

    a. Copy the CONTENT, with the exception of creating a backup copy on a second computer owned and used by you. Do not disclose, publish, export, distribute, rent, lease, or sublicense the product.

    b. Remove any trademarks or copyright notices from the CONTENT that belong to Routed Sound.

    c. Modify, translate, or create derivative works based on the CONTENT.

    d. Use the product in a computer-based services business or publicly display the visual output of the CONTENT.

    e. Transmit the CONTENT through audio, digital, or other electronic means, or post the product on any file-sharing site.

  • 3.2. The MEDIA LICENSE includes: a. Mechanical rights: The right to re-record, duplicate, and release the CONTENT as part of your product/production in whatever medium you choose (i.e. video tape, film, CD ROM, DVD, digital formats). This does not include the right to resell the CONTENT as a standalone product in whole or in parts.b. Synchronization rights: The right to use the CONTENT as a soundtrack “synced” with visual images, or sounds as part of your product/production.

    c. Public Performance Broadcast rights: The right to use the CONTENT as part of the public viewing or broadcast of your product/production, including but not limited to videos, DVDs, websites, podcasts, multimedia presentations, films, television, and radio.

    The MEDIA LICENSE is granted worldwide and unlimited in time.

    Users have the right to implement free editions of the products and/or only for non-commercial purposes.

  • 3.3. Scope of License: All sound-based products provided by Routed Sound, including VST presets, audio loops, sample packs, and stem files (collectively referred to as the “CONTENT”), are licensed, not sold, to you by Routed Sound for commercial, educational, and non-commercial use in any medium and through any means now known or hereafter devised. This includes but is not limited to, use in various productions, such as video games, radio, film and TV productions, audio/video post-production, interactive media, broadcasting, online media, multimedia, and similar productions, as well as the physical and digital distribution of these productions and any related promotional or advertising activities, all of which are produced by you during the TERM of this AGREEMENT on a global scale (collectively referred to as “PRODUCTION”).This license explicitly prohibits the unauthorized integration of the CONTENT into any library, whether online or offline (such as sample instruments, sound effects libraries, stem files, or production music company’s SFX toolkits), without our explicit written permission. Furthermore, you may not redistribute the CONTENT in any form, including, but not limited to, selling, trading, sharing, resampling, mixing, processing, isolating, or embedding it into software or hardware, with the intent of re-recording or reproducing it as part of any commercial or free library of musical and/or sound effect samples or articulations, or any system or device for playing back musical or sound effect samples. The use of the CONTENT for the purpose of training an AI is also strictly prohibited without obtaining written consent from Routed Sound.

4. Price Changes
Routed Sound may, at any time, change or alter the price of its products. Routed Sound does not offer refunds in the event of a price drop or promotional offers.

5. Digital Delivery
All orders placed on the Routed Sound website are delivered digitally via the Internet. They are not sent via post or delivered to the customer as tangible goods.

While every effort is made to update the information on the Routed Sound website, neither Routed Sound nor any third-party or data/content provider makes any representations or warranties, whether express, implied by law, or residual, regarding the sequence, accuracy, completeness, or reliability of the information, opinions, research data, and content contained on the Routed Sound website. Routed Sound shall not be bound in any manner by any information contained on the site. Routed Sound reserves the right to change or discontinue, without notice, any aspect, product, or feature of this website at any time. No information provided on this website should be construed as advice, and it is offered for informational purposes only.

External links may be provided for your convenience, but they are beyond the control of Routed Sound, and no representation is made as to their content. By using the Service or providing personal information to us, you consent to receive communications from us, primarily through email. These communications from us and our affiliated companies may include, but are not limited to:

Operational communications related to your Account or the use of the Service.

News about Routed Sound and industry developments.

If you wish to stop receiving promotional emails, you can choose to unsubscribe from our promotional email list by following the instructions provided in the promotional emails.

Trademarks

The Company name Routed Sound, the Routed Sound logo, and other Routed Sound logos and product and service names are registered or unregistered trademarks of Routed Sound (the ‘Routed Sound Marks’). Without our prior written permission, you are not authorized to display or use the Routed Sound Marks in any manner.

Payment Terms

1. Payment
You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. As a condition for purchasing our products and services, you must either provide Routed Sound’s Third-Party Payment Processor with a valid credit card or debit card number (Visa, MasterCard, or any other issuer accepted by us) or allow for payment through your PayPal account (“Payment Provider”). Your Payment Provider agreement governs your use of the designated credit card, debit card, or PayPal account, and you must refer to that agreement, not this Agreement, to determine your rights and liabilities.

By providing Routed Sound with your credit card or debit card number or PayPal account and associated payment information, you agree that Routed Sound is authorized to immediately charge your Account for all fees and charges due and payable to Routed Sound hereunder and that no additional notice or consent is required. You agree to promptly notify Routed Sound of any change in your billing address or the credit card, debit card, or PayPal account used for payment hereunder. We may also receive updates to your credit card, debit card, or other payment information from our payment processors.

2. Product and Access charges
You are responsible for making the payment for the relevant product or service when you create your Account and select your product or access. Unless otherwise specified in the Agreement, all charges for the product and service are non-refundable.

3. Taxes

  • 3.1. Tax Responsibility: It is your responsibility to pay any applicable taxes associated with the use or purchase of our products or services. These taxes may include, but are not limited to, sales tax, use tax, value-added tax (VAT), or goods and services tax (GST).
  • 3.2. Tax Invoices: If required by law, we will provide a valid tax invoice for the products or services you purchase from us.
  • 3.3. Tax Compliance: You agree to comply with all relevant tax laws and regulations in your jurisdiction. We do not provide tax advice, and you are encouraged to consult with a qualified tax professional for guidance regarding your tax obligations.
  • 3.4. Changes in Tax Laws: We reserve the right to modify our prices or billing methods to account for any changes in tax laws or regulations.
  • 3.5. Tax Exemptions: If you believe you qualify for a tax exemption, it is your responsibility to provide us with any required documentation or information necessary to process such exemptions.
  • 3.6. Indemnification: You agree to indemnify and hold us harmless from any claims, liabilities, costs, or expenses related to your failure to fulfill your tax obligations.

Disclaimer of Warranties

1. To the fullest extent permitted by law, (a) the service, Routed Sound property, and content made available through the service are provided “as is” and on an “as available” basis. (b) Routed Sound asserts disclaimers of all warranties, whether express or implied, including, but not limited to: (i) any implied warranty of merchantability, fitness for a particular purpose, title, quiet enjoyment, or non-infringement, and (ii) any warranty arising out of the course of dealing, usage, or trade, to the fullest extent permitted by law. Routed Sound expressly states that it does not warrant that the service will operate uninterrupted, timely, secure, or free from errors, viruses, or other harmful components. Nor does it warrant that any of the aforementioned issues will be corrected, or that the results obtained from utilizing the service will be accurate or reliable.

At your sole discretion, you opt to access any content downloaded from, or otherwise obtained through, the service with full awareness that such access is entirely at your own risk. In consequence, you shall bear exclusive responsibility for any damage incurred by your property, including but not limited to your computer system and any device utilized for accessing the service, or any other losses resulting from the act of accessing said content.

No form of counsel or information, regardless of whether it is conveyed orally or through written means, received from Routed Sound or via the service, shall serve to establish any warranty unless such warranty is specifically and expressly stipulated herein.

2. No Liability for Conduct of Third Parties
You acknowledge and agree that the Routed Sound entities are not liable, and you agree not to seek to hold the Routed Sound entities liable, for the conduct of third parties, including third-party service providers, and operators of third-party websites, third-party applications, or third-party ads. You further acknowledge that the risk of injury from such third parties rests entirely with you.

3. Third-Party Materials
As a part of the Service, you may have access to materials that are hosted by another party. You acknowledge that Routed Sound cannot feasibly monitor such materials and that your access to these materials is at your own risk.

Suspension and Termination

We reserve the right, at our sole discretion, to suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason whatsoever, including but not limited to:

  • Sharing your account credentials or allowing others to access your account.
  • Use of automated tools, bots, scripts, or any other automated means to access or interact with the Service.
  • Engaging in activity that we, in our sole judgment, consider to be suspicious, fraudulent, or in violation of these Terms or applicable laws.

Upon termination, your right to use the Service will immediately cease, and we may delete or deactivate your account and all related information without liability to you.

Limitation of Liability

To the fullest extent permitted by law, under no circumstances shall Routed Sound, its affiliates, officers, employees, agents, service providers, partners, and licensors (hereinafter referred to collectively as “Routed Sound entities”) be liable to you for any indirect, incidental, special, consequential, or punitive damages. This includes damages for loss of profits, goodwill, or any other intangible losses arising from or related to your access to, use of, or inability to access or use the service or any materials or content on the service. This limitation applies regardless of whether the claim is based on warranty, contract, tort (including negligence), statute, or any other legal theory, and even if any Routed Sound entity has been made aware of the possibility of such damages.

To the fullest extent permitted by law, the Routed Sound entities’ aggregate liability to you for all claims arising from or related to the use of any portion of the service or any inability to use it, or otherwise under these terms, whether arising in contract, tort, or otherwise, shall be limited to the greater of $100 and the amounts you have paid to Routed Sound, if any, during the six-month period preceding the date of your claim against us.

Each provision within these terms, which includes limitations of liability, disclaimers of warranties, or exclusions of damages, is designed to and effectively allocates the risks between the parties under these terms. This risk allocation forms an indispensable part of the foundation of the agreement between the parties. Each of these provisions is distinct and can stand independently from all other provisions in these terms.

To the fullest extent permitted by law, you are solely responsible for your use of the Service, and you agree to indemnify and hold harmless the Routed Sound Entities from any and all claims brought by third parties, as well as any associated liability, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising from or related to (a) Your unauthorized use of, or improper use of, the Service; (b) Your violation of any part of the Agreement or any applicable law or regulation; (c) Your violation of any third-party rights, including but not limited to intellectual property rights, rights to privacy, confidentiality, or any other property rights; or (d) Any disputes or issues that may arise between you and any third party.

We reserve the right, at our own expense, to assume exclusive control and defense of any matter subject to indemnification by you (without diminishing your indemnification responsibilities for that matter). In such cases, you will cooperate with our defense of these claims.

Third-Party Services

1. Payment Processor
Routed Sound currently uses PayPal Holdings, Inc. and its affiliates (for processing PayPal transactions) and Stripe, Inc. and its affiliates (for processing credit card and debit card transactions) as the third-party payment processors for payment services, (e.g., card acceptance, merchant settlement, and related services) (“Third-Party Payment Processor“). By buying the Service, you agree to be bound by the Third-Party Payment Processor’s privacy policy (currently accessible at PayPal Privacy Policy and Stripe Privacy Policy) and hereby consent and authorize Routed Sound and the Third-Party Payment Processor to share any information and payment instructions you provide with each other to the maximum extent required to complete your transactions.

2. Website Protection and Performance
This site uses Cloudflare, Inc. (“Cloudflare”) for content delivery network (CDN) services, DDoS protection, and website performance optimization. By using the Service, you acknowledge that your data may be processed by Cloudflare in accordance with the Cloudflare Privacy Policy.

This site is protected by reCAPTCHA and the Google Privacy Policy and Terms of Service apply.

3. Analytics and Session Recording
We use Microsoft Clarity to monitor user interaction on our site through session recording and heatmaps to improve user experience and site functionality. By using the Service, you consent to Microsoft’s collection and processing of your data as described in the Microsoft Privacy Statement.

Routed Sound respects the intellectual property rights of others. If you believe your work or someone else’s has been reproduced in a way that may be deemed as copyright infringement you may notify our agent by providing the following information:

  • Contact information
  • The copyrighted work or works that are being claimed to be infringed upon
  • Identify allegedly infringing material
  • Link to or location of allegedly infringing material or activity
  • Include the physical or e-signature of the person authorized to act on the copyright owner’s behalf
  • Include a statement that the complaining party has a good faith belief that the infringing material is not authorized by the copyright owner, the copyright owner’s agent, or the law
  • Include a statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner

1. Acceptance of Terms
